General Terms and Conditions - Gemas de Tavira

1. Scope
These conditions apply to all direct bookings with Gemas de Tavira, both via contract and via the Beds24 booking system.
All accommodations fall under Portuguese legislation for Alojamento Local (Decreto-Lei nr. 128/2014 and later amendments). For EU consumers, Directive 2011/83/EU on consumer rights additionally applies.

2. Booking and Confirmation
A booking is only final after written confirmation via email by the landlord and payment of the deposit by the tenant. Until both conditions are met, the landlord reserves the right to offer the requested period to others.
Only email communication is legally valid.

3. Payment
3.1 Payment Schedule
Deposit: 50% of the total amount, to be paid within 1 week after confirmation
Balance + Deposit: remaining 50% + €300 deposit, no later than 1 month before arrival
3.2 Payment Method
Payment via bank transfer to IBAN or via the integrated payment system on Beds24.
3.3 Late Payment
If the deposit is not paid before the due date, the reservation will automatically lapse. If the balance or deposit is not paid, the booking will be considered canceled according to the conditions in §4.
3.4 VAT Invoice
If desired, this must be reported in writing before the end of the rental period, including full invoicing details.

4. Cancellation
• More than 60 days before arrival: €50 administration fees
• 60 to 31 days before arrival: 50% of the total amount will be refunded
• Less than 31 days before, on, or after arrival: no refund
• Early departure or No-show: no refund
The landlord can propose a commercial solution, without prejudice to the above conditions if they are not accepted by the tenant.
We strongly recommend taking out travel/cancellation insurance that also covers pandemic situations.

5. Check-in and Check-out
The rule: Check-in at 16:00 - Check-out at 10:00
In consultation and after confirmation by the landlord, this can be changed to other times.
Ignoring agreed times: If the agreed times are not respected, a fee of €25 per change may be charged.

6. Identification and Registration of Guests
All foreign guests - everyone except Portuguese citizens residing in Portugal - must be registered with the Portuguese immigration service AIMA (formerly SEF).
The landlord will request the necessary information before or upon arrival.
If these details are not provided, the booking will be considered canceled by the tenant without refund, according to §4.
The stay of other or more persons than stated in this registration is not permitted, not even temporarily. If this is established, the booking can be terminated immediately without refund.

7. Number of People
The accommodation may not be occupied by more people than stated in the booking. This applies to all ages, including babies. Changes in the number of people, including temporary visitors, must be discussed in advance via email and may or may not be approved.

8. Pets
Pets are not allowed unless previously discussed in writing and explicitly permitted via email.

9. Use of Accommodation
Permitted Use
The accommodation is intended for temporary residence for vacation, work, or other short-term stay purposes.
Not Allowed
• Use as primary residence or permanent home.
• Parties, events, or commercial activities.
• Professional photo shoots or video recordings without prior permission.

Smoking
Smoking outside is allowed, provided windows and doors remain closed to prevent smoke nuisance inside.

10. Duty of Care and Responsibility
The tenant is responsible for careful, hygienic, and correct use of the accommodation, its contents, and all facilities. This includes, but is not limited to:
• Sufficient ventilation to prevent mold
• Preventing waste of utilities
• Storing food correctly and removing waste promptly to avoid attracting insects
• Using facilities and amenities only for their intended purpose
The landlord reserves the right to terminate the stay without refund if:
• The accommodation or inventory is treated carelessly
• Hygiene risks arise
• There is unacceptable behavior towards neighbors, other guests, or the landlord
• The conditions of this agreement are not complied with

11. Maintenance of Facilities
Access for Maintenance
The landlord or his representatives must have access to the accommodation for necessary maintenance of facilities such as swimming pool, jacuzzi, technical installations, garden, or other amenities.
This maintenance will be announced and planned in consultation, unless it concerns emergency repairs.
Prohibited Manipulation
It is strictly prohibited to manipulate or adjust installations (such as swimming pool/jacuzzi equipment, heating systems, or other equipment) without explicit permission.
Consequences of Violation
If manipulation leads to damage, danger, quality problems, or loss of use for subsequent guests, the following costs may be charged:
• Repair costs (labor, materials, products)
• Replacement of water or other consumables
• Any compensation for loss of use by subsequent guests
The minimum fee for established improper manipulation of installations is €150.

12. Deposit
A deposit of €300 is required as security for:
• Damage to accommodation or inventory
• Loss or theft of items
• Exceptional cleaning costs
• Non-compliance with conditions
Refund
The deposit will be refunded within 7 days after departure via the same payment method used for booking, provided that:
• No outstanding amounts
• No damage or loss during final inspection
• No exceptional costs
If damage or costs exceed the deposit, the difference will be charged to the tenant.

13. Damage and Defects
Obligation to Report
Damage, defects, or malfunctions must be reported immediately to the landlord. In case of urgent matters, a solution will be sought as soon as possible.
Liability
The tenant is liable for all damage caused by themselves or their travel party during the stay
Damage or loss found during the final inspection that was not included in the initial inspection will be charged to the tenant.

14. State of the Accommodation
The state of the accommodation and inventory is established by both parties upon arrival and compared upon departure.
Any deviations or defects upon arrival must be reported and recorded immediately.

15. Cleaning and Linen
Final Cleaning
Final cleaning is included in the rental price. You do not need to clean or strip the beds.

Interim Cleaning and Linen Changes
For stays longer than 10 days, we provide interim cleaning sessions and changing of bed linen and towels. The frequency depends on the duration of the stay and will be agreed upon in consultation. This is not optional.

Upon Departure
You leave the accommodation tidy and take out the trash according to local rules.

Exceptional Pollution
In case of exceptional pollution (pets despite the ban, serious stains, extreme mess), additional cleaning costs may be charged via the deposit.

16. Facilities and Consumables
Available Facilities
Electricity, water, gas, internet, television, and final cleaning are included in the rental price.

Advertisement Discrepancies
The facilities listed in advertisements may vary slightly, as the options in booking systems are not always identical to the facilities actually present.

Consumables
Upon arrival, a starter package is provided. Otherwise, the principle of self-catering holiday rental applies: you provide your own additional consumables.

17. Interruptions and Force Majeure
The landlord is not liable for:
• Temporary interruptions in utilities (water, electricity, gas, internet)
• Circumstances beyond his control (weather conditions, force majeure, government measures)
• Technical malfunctions that occur despite correct maintenance
In case of malfunctions, a solution will be sought as soon as possible.

18. Privacy and Data Processing (GDPR)
Your personal data will be processed exclusively for:
• Communication about the booking
• Legal registration with AIMA (formerly SEF)
• Booking administration and invoicing
This is done in accordance with the European General Data Protection Regulation (GDPR - EU 2016/679). Data will not be shared with third parties, except where legally required (AIMA registration).

19. Changes and Reservations
The landlord reserves the right to adjust prices and offers and to make changes to websites or publications without affecting existing confirmed bookings.
The landlord is not responsible for:
• Typographical errors on websites or in communication
• Changing local prices for utilities
• Incorrect information from business partners

20. Disputes
Disputes are preferably resolved amicably through direct consultation between landlord and tenant.
In case of disagreement, only the Portuguese court in the jurisdiction where the accommodation is located is competent.

Agreement
By completing and confirming a booking with Gemas de Tavira, the tenant declares to have read, understood, and accepted these general terms and conditions.

Cancellation policy :
* More than 60 calendardays before arrival date: 50€ administration fee.
* From 60 to 31 (included) calendardays before the arrival date: 50% of the total price of the cancelled period to be paid.
* Less than 31 calendardays before, on, or after the arrival date: 100% of the total price of the cancelled period to be paid.
We may make a commercial proposal, but in the event of non-agreement, the above conditions remain valid.
We strongly recommend that you take out travel/cancellation insurance that also covers pandemic situations.
