**1. Scope of Application**
These General Terms and Conditions apply to all contracts for the rental of rooms and all related services. Special agreements are permitted and take precedence; otherwise, these terms apply subsidiarily.

**2. Definitions**
Host: A natural or legal person who accommodates guests for payment.
Guest: A natural person using the accommodation; includes accompanying persons.
Contractual Partner: A natural or legal person, domestic or foreign, booking accommodation for themselves or a third party.

**3. Conclusion of Contract – Advance Payment**
A contract is formed upon acceptance of a booking. Electronic declarations are deemed received once retrievable under normal circumstances.
An advance payment may be required for contract conclusion and must be paid no later than 7 days before arrival.
The contractual partner bears transaction costs. The advance counts as part payment.

**4. Start and End of Accommodation**
Check-in: from 1:00 p.m.
Check-out: by 10:00 a.m. at the latest. Late check-out incurs an extra day's charge.
Check-in before 6:00 a.m. counts as the first overnight stay.

**5. Cancellation / Cancellation Fees**
Up to 4 days before arrival: 10% cancellation fee. Thereafter: 100%.
No-show without prior notice voids the accommodation obligation.
In exceptional cases (e.g., natural disasters), the payment obligation for arrival days is waived, but resumes if arrival occurs within 4 days.

**6. Rights of the Contractual Partner**
Right to use the booked rooms and common facilities in accordance with house rules.

**7. Obligations of the Contractual Partner**
Full payment including additional services is due by departure.
Foreign currencies need not be accepted.
The partner bears costs of cashless payments.
Liability for all damages caused by themselves or accompanying persons.

**8. Rights of the Host**
Right of retention and legal lien on items brought in case of payment default.
Additional charges may apply for services outside standard hours.
Interim billing is allowed.

**9. Liability for Items Brought In**
Liability only up to the statutory limit (§§ 970 ff ABGB), and only upon handover or safekeeping by the host.
Liability only for gross negligence or intent.
No liability for unreported or delayed reported damages.
For valuables, a maximum of €550 applies unless a written safekeeping agreement is made.

**10. Liability Limitations**
For consumers: No liability for slight negligence except for personal injury.
For businesses: No liability except in cases of intent; no liability for consequential or lost profit damages.

**11. Pets**
Pets are not permitted. Unauthorized pet presence leads to immediate contract termination without refund.
All damages caused must be fully compensated.

**12. Extension of Accommodation**
No entitlement to an extension. In the event of natural events (e.g., floods), automatic extension may occur – possibly at a reduced rate.

**13. Premature Termination of Contract**
In cases of violations (e.g., misconduct, payment default, illness), the contract may be terminated immediately.
Early departure does not relieve payment obligation.

**14. Illness or Death of the Guest**
The host will arrange medical care if necessary, at the guest’s expense.
Costs for disinfection, damaged furnishings, or unusable room time may be claimed.

**15. Jurisdiction and Applicable Law**
Place of performance is Schwechat. Austrian law applies exclusively.

**16. Miscellaneous**
Deadlines begin with delivery. Declarations must reach the contractual partner by midnight on the final day.
Offsetting counterclaims is only permitted in cases of insolvency or legally confirmed claims.
In case of regulatory gaps, statutory provisions apply.

**17. Wi-Fi Disclaimer**
Free Wi-Fi access is provided. Usage is at your own risk.
No liability for outages, security issues, or illegal use.
Users are liable for all resulting damages.

**18. House Rules**

- Rooms may only be used by the agreed number of persons.
- Cleanliness must be maintained at all times.
- Willful damage or removal of inventory will be charged.
- Damages must be reported immediately.
- Smoking is prohibited throughout the building. A €200 cleaning fee applies for violations.
- Regular ventilation is required.
- Heaters must be turned down or off when absent.
- Only standard household electrical devices may be used.
- Quiet hours: 8:00 p.m. to 8:00 a.m. – including the courtyard.
- Visitors must leave by 11:00 p.m.
- Payments must be made independently and on time.
- Pets are not allowed.
- Possession or use of illegal substances will result in legal action and immediate eviction.

- Hair dye and coloring agents may not be used in bathrooms/showers. Cleaning costs will be charged to the responsible party.
- Breaches of house rules result in immediate contract termination without refund.

**19. Severability Clause**
If any provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected.
The invalid provision will be replaced by one that most closely approximates its economic intent.
